Instagram and Facebook terms and conditions

§ 1 General

Participation in the raffle of the Instagram page: “gebo.group” and/or the Facebook page “GEBO Germany” / @GEBO.Germany (in the following called “the organizer”), is only possible under inclusion of these terms and conditions. The competition is not supported by Instagram or Facebook and is not connected to Instagram or Facebook.

§ 2 Conditions of participation

By participating in the raffle, the user expressly accepts these general conditions of participation. All natural and legally competent persons with a minimum age of 18 years can participate. Employees of the organizer are excluded from participation. Participation is only possible with the highly personal Instagram/Facebook participation (the own Instagram/Facebook account). If the organizer receives knowledge of technical manipulations or any other violation of these conditions of participation, he will exclude the participant from the competition. Technical manipulation includes, but is not limited to, the multiple registration of a person, participation via a lottery service or similar automated collective participation services. In these cases, the prize may be subsequently withdrawn, and a replacement winner drawn. By participating, the participant agrees that his/her name and/or picture will be published on the Internet in the event of a win. Participation is only possible within the period of time stated in the description of the competition. Legal action is excluded.

§ 3 Winning

The prize will be awarded, as specified, in the competition. A change or cash payment of the prize is excluded. The winner will be notified by the organizer, as described in the competition. If the winner does not contact us within the time limit of the prize notification, the prize will be forfeited without compensation.

§ 4 Liability

Claims for damages against the organizer in connection with the raffle are – within the legally permissible limits – excluded regardless of the legal grounds unless the organizer has violated legal obligations intentionally or through gross negligence. Furthermore, the organizer is not liable for damages resulting from the impairment of the availability of the competition website in the case of technical faults and events of force majeure which cannot be influenced, as well as attacks by third parties against the competition website. However, the organizer will do everything possible to ensure the reliability and functionality of the competition website. Furthermore, the organizer does not guarantee that the competition website will function properly on the respective participant’s computer.

§ 5 Data protection

In the context of this raffle, the organizer will maintain the highest standards of data protection and will observe the relevant legal provisions, in particular the EU Data Protection Regulation (DSGVO).

If participants communicate with the organizer in the context of this competition via social media (e.g. Facebook, Instagram) (e.g. by comments or sending messages), the legal basis for the processing of personal data obtained in this way is the organizer’s legitimate interest in communicating with the participants (Art. 6 para. f DSGVO) and, if applicable, the fulfilment of contractual or pre-contractual obligations (Art. 6 para. b DSGVO). Furthermore, the social networks only provide the organizer with aggregated data that does not allow conclusions to be drawn about individuals.

The organizer processes the personal data of the participants exclusively for the purpose of the execution of the competition. The data will be deleted at the end of the competition. No personal data will be passed on to third parties by the organizer.

§ 6 Premature termination of the raffle

The organizer reserves the right to modify, cancel or terminate the competition due to unforeseen circumstances without prior notice regarding the elements of the competition. The latter shall apply if software and/or hardware errors occur and/or other technical and/or legal reasons influence or render impossible the regular and proper execution of the competition.

§ 7 Salvatory clause

Should single provisions of these conditions of participation be ineffective or there is a gap in the regulations, this does not affect the effectiveness of the remaining provisions. The invalid or missing provisions shall be replaced by a provision which comes closest to the purpose of the contract and the legal provisions.

§ 8 Place of jurisdiction / applicable law

In case of disputes, German law applies exclusively. As far as legally permissible, the place of jurisdiction shall be the registered office of the organizer. If the participant does not have a general place of jurisdiction in Germany, or if he/she moves his/her place of residence abroad after participation, the organizer’s registered office is also agreed as place of jurisdiction. Legal recourse is excluded.

§ 9 Selection procedure

The winner is determined by drawing lots. Legal recourse is of course excluded here as well.
